3.03    Pedestrian Passage:  The LICENCEE agrees that all portions of the sidewalk abutting the LANDS will have a minimum of two (2) metres of continuous unobstructed space along the entire frontage LANDS for the movement of pedestrians. This distance shall be measured perpendicular from the curb, toward the LANDS, to the closest obstruction and shall not serpentine along the HIGHWAY.

A certificate of Insurance is required with the City names as a co-insured in an amount of no less than $5,000,000.00 (is required when serving alcohol), $2,000,000.00 (is required if NOT serving alcohol).

3.16    Liability Insurance:  The LICENCEE agrees to place and at all times maintain General Liability insurance including but not limited to bodily injury including death, personal injury, property damage including loss of use thereof, contractual liability, if applicable liquor liability up to the full policy limits and contain a cross liability/severability of interest clause against claims arising out of any of the operations of the LICENCEE or the acts or omissions of the LICENCEE. This insurance shall be with a company or companies acceptable to the CITY and all policies for this insurance shall be in an amount of no less than $5,000,000.00 (is required when serving alcohol), $2,000,000.00 (is required if NOT serving alcohol) and in a form satisfactory to the CITY. The CITY shall be named as an additional insured on any such policy. If the insurance provided under the said policy(ies) is cancelled or if coverage is reduced, the insuring company will give (30) days written notice in advance by registered mail of such a cancellation.

Annual Fee for Patio License

3.01    Covenant to pay LICENCE FEE:  The LICENCEE agrees to pay to the CITY at the time that this AGREEMENT is executed, a non-refundable fee of $317.00 (subject to annual fee increase) for the right to use the LANDS in accordance with this AGREEMENT.

The Patio License Agreement Application Fee is non-refundable or transferrable.
