Exemption Process
All noise related events that extend over three days, multi-day construction activities related to residential or commercial construction and activities related to municipal infrastructure shall be directed to Council by memo or as an agenda item. For information purposes Council notification shall include the Manager of Municipal Law Enforcement and Licensing.
All exemption requests shall be applied to and processed by Municipal Law Enforcement and Licensing.
- All exemption applications shall be accompanied by an Administrative Fee as described in the Consolidated Fees By-Law. Applications will not be processed until the fee is received. The Administrative Fee is non refundable once processed.
- Please note that online payments are not currently available for this form, to submit the $77.00 application fee please call the Municipal Law Enforcement and Licensing Office at 705-324-9411, extension 1212 or email By-Law Complaints.
- Exemption applications are to be submitted 45 days prior to the event occurring. Caution to the applicant that applications received less than 45 days of the event may not be approved.
- The applicant is required to provide notice of the noise exemption request application to residents who reside within 500 metres of the location property at least 40 days prior to the event occurring. The applicant shall direct all respondents to reply directly to the Manager of Municipal Law Enforcement and Licensing, or designate.
- The Manager of Municipal Law Enforcement and Licensing or designate may approve the noise exemption request application, grant an alternative exemption or refuse such exemption. The approval may include any conditions that are considered appropriate.
- Approval or denial notification of the noise exemption application will be provided to the applicant within 14 days of receipt of the exemption application.
- All noise exemption requests will be circulated to the following for review and optional comment:
- Kawartha Lakes Police Service - Chief of Police
- Kawartha Lakes Ontario Provincial Police – Detachment Commander
- Kawartha Lakes Fire Service – Fire Chief
- City – Director of Community Services
- City – Director of Development Services
- City – Director of Public Works
- Once the exemption request is processed the applicant shall be notified in writing or by other means regarding the results (approved, denied, modified approval). The approved noise exemption will be in effect for the date and times specified.
